1. About These Terms
These Terms of Service (“Terms”) are an agreement between you and Dikuta Inc (“Dikuta”, “we”, “our”, “us”). They apply when you visit dikuta.com, join our waitlist, or use our WhatsApp-based money transfer service (together, the “Service”). By using the Service you accept these Terms. If you do not accept them, please do not use the Service.
Our Privacy Policy explains how we handle your personal data and forms part of these Terms.
2. Eligibility
To use the Service you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding contract
- Use the Service on your own behalf, not on behalf of someone else, unless we have agreed otherwise in writing
- Not be subject to sanctions, and not be located in a country subject to comprehensive sanctions
- Provide accurate information about yourself and about anyone you send money to
3. The Waitlist
Joining our waitlist does not create an account, does not guarantee access to the Service, and does not oblige us to provide it to you. We may contact you about our launch using the details you gave us, for as long as you have not withdrawn your consent. You can ask us to remove you at any time by emailinginfo@dikuta.com.
4. Identity Verification and Compliance
Money transfer is a regulated activity. Before and while providing the Service we are required to verify your identity, screen transactions, and monitor for financial crime. By using the Service you agree that we may:
- Ask you for identity documents and other information, and verify them with third parties
- Delay, hold, or decline a transfer while we complete checks
- Refuse a transfer, suspend your access, or end our relationship with you, where we are required or reasonably believe it necessary to do so
- Report transactions and information to regulators and law enforcement
We may not always be able to tell you why a transfer was held or declined, where telling you would breach the law.
5. Sending Money
Before you confirm a transfer we will show you the amount you are sending, the exchange rate we are applying, any fees, and the amount the receiver should get. A transfer is only accepted once we have received your payment in cleared funds and your transfer has passed our checks.
You are responsible for the details you give us. We send money to the mobile wallet number you provide. If you give us the wrong number, we may not be able to recover the money, though we will make reasonable efforts to help you.
6. Timing
Most transfers reach the receiver's mobile wallet within minutes of your payment clearing. We cannot guarantee a delivery time. Transfers can take longer where we need to complete verification or compliance checks, where the receiving mobile money provider or its network is delayed or unavailable, or where the details you gave us need correcting.
7. Fees and Exchange Rates
Our fees and the exchange rate that applies to your transfer are shown to you in the chat before you confirm. Exchange rates move, and the rate we quote is valid only for the period stated at the time. The receiver's mobile money provider may apply its own charges, which are outside our control.
8. Cancellation and Refunds
You may ask us to cancel a transfer, and we will do so if the funds have not yet been paid out to the receiver. Once the money has reached the receiver's wallet it cannot be reversed by us. Where a transfer fails or is cancelled in time, we will refund the amount you paid, including our fee, to the payment method you used.
If you think something has gone wrong with a transfer, contact us atinfo@dikuta.com as soon as you can and we will investigate.
9. Acceptable Use
You must not use the Service to:
- Break any law, or help anyone else do so
- Launder money, finance terrorism, or move the proceeds of crime
- Evade sanctions or send money to a sanctioned person or country
- Commit or facilitate fraud, including sending money on behalf of someone you do not know
- Run a business, bureau de change, or money transfer operation of your own through your access
- Interfere with, probe, or attempt to gain unauthorised access to our systems
10. Complaints
If you are unhappy with the Service, email info@dikuta.comwith the word “Complaint” in the subject line and tell us what went wrong and what you would like us to do. We will acknowledge your complaint within 3 business days and aim to give you a final response within 15 business days. If we need longer, we will tell you why and when to expect an answer.
11. Availability of the Service
We aim to keep the Service available, but we do not guarantee that it will be uninterrupted or error-free. The Service depends on third parties, including WhatsApp, payment processors, and mobile money providers, and may be unavailable when they are. We may change, suspend, or withdraw any part of the Service, and we will give you reasonable notice where we can.
12. Limitation of Liability
Nothing in these Terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded.
Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, business, or opportunity. Our total liability to you in connection with a transfer is limited to the amount of that transfer plus the fees you paid on it.
We are not responsible for the acts or omissions of mobile money providers, banks, or payment processors outside our reasonable control, or for losses caused by inaccurate details you gave us.
13. Changes to These Terms
We may update these Terms. We will post the updated version on this page with a new effective date, and where a change materially affects your rights we will tell you before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Colorado and the federal laws of the United States, without regard to conflict of law principles. Nothing in this section removes any protection or right to bring proceedings locally that consumer law in your country of residence gives you and that cannot be waived by agreement.
